Terms & Conditions

Article 1 - Purpose of the Contest

Hospitality Afrik is launching a competition to called "AFRICA’S NEXT MAKEUP ARTIST" hereinafter referred to as the Contest".

The aims of ANMUA competition are to:

  • provide prizes to the various categories of winners
  • impact entrepreneurship skills in contestants
  • become the most outstanding human decorative challenge in Africa
  • showcase the rich talents in the human decorative sector
  • showcase the brands central to the human decorative sector
  • showcase valuable Investment opportunities in the human decorative sector
  • provide a platform to showcase the people, diverse cultures and traditions

Article 2 - The Organizer

The competition is organized by Hospitality Afrik a subsidiary of Highburry Communications Limited with office at 45 Abosede Kuboye Crescent, Eric-Moore, Surulere, Lagos (the " Organizer"):

A copy of these terms and conditions of the Contest (the "Rules") in English will be filed with the relevant statutory body. They will also be sent, free of charge, to any person who so requests them from the Organizer during the Contest period.

The Rules may be amended or supplemented at any time by the Organizer without prior notice. Any modification to the Rules will be subject to a new submission to a law officer, and will enter into force once the said modification has been posted on the Site. Any Candidate objecting to the modification(s) made to the Rules shall immediately withdraw from the Contest.

Article 3 - Conditions of participation

The Contest is open to all individuals of legal age (at least 18 years old) in their country of origin who have registered on the dedicated area of the website (AFRICA’S NEXT MAKE-UP ARTIST) after payment of prescribed fee

Article 4 - Participation of the Candidates

To enter the Contest, Candidates must complete the Application form in English on the website once. Any attempt by any entrant to enter more than once by using multiple/ different identities, registrations, logins, addresses or through any other methods, will void all of that entrant’s entries and that entrant will be disqualified. Entries generated by script, macro, mechanical or other automated means or by any means which subvert the entry process are void. All Entries become the sole property of the Organizer and will not be returned. Once the Application is complete, a confirmation of receipt will be sent by the Organizer to the candidate at the email address specified at registration.

Article 5 - Application Form

How to submit your application form:

Registration will take place on the website from time and date specified by clicking on the "AFRICA’S NEXT MAKEUP ARTIST CONTEST".

Candidates must fill in the following mandatory fields: First Name, Last Name, Email, Mobile phone number, Date of Birth, Full contact Address, link to your Instagram page (Your Instagram profile must be made public) and do the following:

  1. Create a make-up of yourself or a model
  2. Post a clear and close-up photo of the make-up done on yourself or a model and tag

it with #Africanextmakeupartist

The photo will appear under the Applicants

The Photo must be a colored photo, in close-up (face/chest), portrait format and not photoshopped or altered by any other program or means. The Photo must be uploaded to the Site. The Organizer, in its sole discretion, will have the right to determine whether the Photo comply with the Rules, and the Organizer’s judgment shall be final and cannot be challenged. These Rules must be accepted in order to validate your candidacy.

The Candidate must then click on the "Enter" button for their Application to be considered.

The themes which the Application must meet:

Candidates wishing to enter the competition must create a model makeup of themselves or use a model look to create makeup, who must be 18 years of age or older and who must have granted permission, in writing, to appear in the Video, the Photo and this Contest and to grant to the Organizer the right to use the Video and Photo in accordance with the terms of these Rules.

Candidates must secure consents and releases from all individuals and models who appear in or are involved in creating their photos and Video (see Article 9). A sample release may be provided on the Site for reference purposes only. The Candidate will be as creative as possible and must think outside the box.

CONTENT RESTRICTIONS: Applications may not contain, as determined by the Organizer, in its sole discretion, any content that:

  • is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic,
  • racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the
  • foregoing); promotes any activities that may appear unsafe or dangerous; promotes any
  • particular political agenda or message;
  • is obscene or offensive; endorses any form of hate or hate group;
  • appears to duplicate any other submitted Entries;
  • defames, misrepresents or contains disparaging remarks about the Organizer, its
  • products or services, other people or companies;
  • contains trademarks, logos, or trade dress (such as distinctive packaging or building
  • exteriors/interiors) owned by others, without permission, to the extent permission is
  • necessary;
  • contains copyrighted materials owned by others (including photographs, sculptures,
  • paintings, and other works of art or images published on or in websites, television, movies or other media) without permission, to the extent that permission is necessary
  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person (living or dead), such as license plate numbers, personal names, e-mail addresses or street addresses, including, without limitation, celebrities and/or other public or private figures, living or dead;
  • communicates messages or images inconsistent with the positive images and/or good will with which the Organizer wishes to associate; and/or
  • violates any law.

Article 6 - Selection of Applications (Stage 1)

This will take place between 15th April and 14th May 2019. The organizers however, reserves the right to extend this selection stage if the need arises.

Our Juries will examine all the DULY registered online Applications with the hashtag #Afriknextmakeupartist using creativity, innovation and uniqueness to nominate 500 entries to advance to the next stage of the competition. The 500 entries will receive make-up products and further tasks for the next looks

Any Application that is incomplete, submitted after the deadline, or contains false or misleading information will be declared inadmissible with no obligation to inform the candidate concerned. Any Candidate whose Application form has been rejected will also not be entitled to any compensation, regardless of the stage of the Contest process.

Article 7 – Voting for the Next top 50 Contestants (Stage 2)

 The Jury selected 500 candidates will be required to perform 2 Make-up tasks given by the organizers.

At this stage, it is up to voters to decide who makes it into the top 50 of the competition.

Voters will have the privilege of deciding who among the 500 candidates move to the last 50 of the competition by voting online for candidates of their choice.

The top 50 candidates with highest number of votes each at the end of the voting process to be announced will emerge and move to the next stage of the competition.

Article 8 – Voting for the Next top 10 Candidates (Stage 3)

 Our distinguished Juries will select the 10 top candidates from among the 50 that will proceed to the grand finale using a 2 sides facial make up divided equally into 2 parts with one side having a make up only and the other a creative make up or another styles at the discretion of the organizers.

Article 9 – Grand Finale (Stage 4)

The 10 finalists will create three make-up looks (themes will be unveiled at the event) on a model.

Accredited Guests at the final event will have a cumulative maximum voting capacity of 40% while the members of the Jury will have 60%.

Each accredited guest can vote a contestant a maximum score of 10 and a minimum of 1

Each contestant’s total vote received from accredited guests will be aggregated to 40%

Our Juries will then select the top 3 winners having the most creative, innovative and unique Make-up presentation
The decisions of the jury are final and binding. Its deliberations will remain confidential and are not subject to appeal.

The 10 potential winners will be sent a confirmation email from HOSPITALITY AFRIK and will be announced on the site with the following URL: https://anmua.hospitalityafrik.com

Article 8 - Winners of the Contest

The 1st, 2nd and 3rd runner ups will each win a cash prize, and other gift items to be announced before the start or during the competition

The value of the total prizes is estimated at approximately N3,000,000  

Potential winners may be required to complete a Declaration of Eligibility, Liability and Publicity Release (unless prohibited by law) as well as any other documents required by the Organizer, which must be returned within fourteen (14) days of date appearing on prize notification. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of the Organizer to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by any potential winner will result in disqualification and, at the Organizer’s sole discretion, the prize may be awarded to a runner-up.

The Organizer will provide the following to the winner: (1) Return flight ticket to Accra, and (2) hotel accommodation costs (room rate and related taxes only) for 3 nights.

In general, the winners will be responsible for ensuring compliance with the administrative and health formalities required for a stay in the country intended for the trip, depending on their personal circumstances, including procedures related to border crossings and their completion times.

The Contest is strictly personal and cannot be transferred to or used by a person other than the winner. Prize cannot be redeemed for cash or substituted. Unless prohibited by law, Winners are responsible for all federal, state and local taxes. Winners will be required to obtain all necessary travel documents, such as passports and visas. All prize details will be determined by the Organizer in its sole discretion. Limit one (1) prize per person/email address.

Article 9 - Intellectual property

Each Candidate hereby grants the Organizer and its successors, licensees and assigns an irrevocable and exclusive license to all intellectual property rights relating to the Video and Photo, including but not necessarily limited to copyright, registered rights to trademarks, as recognized by the laws or regulations of all countries as well as current and future international agreements.

This license is granted, free of charge, for the entire world and for three (3) years starting the commencement date of the competition in each country.

Under this license, the Organizer and its successors, licensees and assigns may use all or part of the video and Photo, by any means and as many times as they deem necessary, for the purposes of presentation, communication and promotion of the Contest, Candidates and their creations, including in the context of the Organizer's corporate communication.

The Organizer and its successors, licensees and assigns are therefore authorized, for a period of three (3) years starting from the commencement date of the competition

  • reproduce or cause to reproduce all or part of the Video and Photo, temporarily or permanently, with or without other intellectual property elements of any nature whatsoever, whether the same or different, by any known or unknown process, on any
  • format known or unknown, whether paper or electronic;
  • represent or cause to be represented the Video and Photo, with or without other intellectual property elements of any nature whatsoever, whether the same or different, entirely or in part, by submission or communication to the public by any means of publication, broadcast and television, known or unknown, including any electronic communications networks, including the Internet;
  • undertake or commission any adaptations, transformations, arrangements, modifications, additions, removal and translations that the Organizer deems necessary for the use of all or part of the Video and Photography.

Each Candidate represents, warrants and guarantees that:

  • the intellectual property rights relating to the Video and Photo exist and agrees to
  • perform all duties necessary to maintain and, where applicable, renew these rights and to bear the charges thereof;
  • Candidate holds all the necessary intellectual property rights allowing them to submit the Video and Photo in this Contest and to grant the aforementioned license, and that Candidate has obtained, where necessary, permission to submit the Video and Photo and grant the license from any persons that may have contributed to the creation of the Video and Photo or who appear in the Video or Photo;
  • Neither the Video nor the Photo infringes upon or violates the rights of any third party or is subject to any dispute or action for infringement, invalidity, revocation or claim.

Each Candidate hereby represents, warrants and guarantees that the Organizer may freely and without restriction use the Video and Photo in accordance with the terms set forth herein without any restriction or obligation to any third party.

In addition, each winner agrees that the Organizer also shall have the right to use all work, videos, photos, recordings and other content produced by the Winner during the training week at the Academy in accordance with the license terms set forth in this Article 9.

Article 10 - Personality rights (Image rights)

Personality Elements shall mean the name, likeness, photograph, voice, biography and any other elements protected under the right to privacy, the right of publicity, and/or similar laws in all countries (whether such laws are in effect now or later enacted) Without limiting the grant of rights set forth above, each Candidate grants to the Organizer and its successors, licensees and assigns irrevocable and non-exclusive permission to use, reproduce, represent and exploit freely, in whole or in part, the Candidate’s Personality Elements, as well as the Personality Elements of any model or other person appearing in the Video and Photography, by any means and as many times as the Organizer deems necessary for the purposes of presentation, communication and promotion of the Contest, Candidates and their creations, including in the context of the Organizer's corporate communication .

This permission is granted, free of charge, for the entire world, in any media now known or hereafter devised and for a period of three (3) years starting the commencement date of the competition.

This permission covers all rights relating to the Personality Elements that may be recognized by the laws or regulations of all countries, as well as current and future international agreements.

As part of their participation in the Contest, each Candidate warrants that they have obtained permission to grant the Organizer the aforementioned permission to use the rights pertaining to the Personality Elements of all third parties whose name and/or images that depict them are communicated by the Candidate to the Organizer, in particular all the permissions required for the image rights of the models appearing in the Photo and/or Video.

Each Candidate represents and warrants that the Organizer may freely and peacefully use the Personality Elements within the Video and Photography, in accordance with the purposes defined above.

In addition, each winner agrees that the Organizer shall have the right to film and photograph in any manner winner’s activities at and participation in the Entrepreneurship training. tours and competition.

Article 11 - Conflict of Interests

The Organizer reserves the right to exclude a candidate or a winner at any time, and, if necessary, to strip the winner of the contest of their prize in the event of non-compliance with the terms of these Rules, the terms and conditions of the Site or for any behaviour that may affect the name and reputation of the organizers, it's directors, managers or employees

Article 12 - Liability

The Organizer cannot be held liable in the event of a force majeure or unforeseeable circumstances beyond its control that disrupt the organization or management of the Contest.

The Organizer cannot be held responsible for theft, damage or any direct or indirect damages of any nature whatsoever, to which the Winners may be subject during their transport and presence at the Africa’s Next Make-UP Artist Contest.

By participating, to the extent permitted by law, Candidate agrees to release, indemnify, discharge and hold harmless the Organizer, YouTube, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from Candidate’s participation in the Contest or any Contest-related activity, the acceptance, possession, use or misuse of any prize and/or the Organizer’s use of the rights granted herein.

To the extent permitted by law, Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Applications or mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Applications, the announcement of the prizes, the incorrect uploading of the video or photo or in any Contest-related materials. To the extent permitted by law, Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of any website. Persons who tamper with or abuse any aspect of the Contest or any website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by the Organizer, will be disqualified and all associated Applications will be void. Should any portion of the Contest be, in the Organizer’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Organizer, corrupt or impair the administration, security, fairness or proper play, or Applications, the Organizer reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect Applications received prior to action taken using the judging procedure outlined above or as otherwise deemed fair and appropriate by the Organizer. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE ORGANISER RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING, WITHOUT LIMITATION, LEGAL FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

Void where prohibited. Contest is subject to all applicable federal, state and local laws

Article 13- Applicable law and settlement of disputes

This Regulation is subject to Nigerian law.

Participation in the Contest implies acceptance of these Rules without reservation or restriction. All practical difficulties of interpretation or Application of these Rules shall be determined exclusively and ultimately by the Organizer.

In the case of a dispute between the Organizer and Candidate, the latter shall, by express agreement, be subject to the jurisdiction of the Courts in Nigeria.
